Rule 17(a)(ii) permits the stand-on vessel to take action to avoid collision only when it becomes clear that the give-way vessel is not taking appropriate action. You must first provide the give-way vessel sufficient time and opportunity to fulfill her obligation to keep clear before you maneuver.
