Scope & Geographic Applicability
Applies to all commercial vessels above 5,000 GT carrying passengers or cargo for commercial purposes. Energy used on voyages between EU/EEA ports and at berth in EU ports is counted at 100%, while voyages entering or leaving the EU are counted at 50%.
Well-to-Wake (WtW) Methodology
Unlike tank-to-wake metrics, FuelEU accounts for the entire lifecycle: Well-to-Tank (WtT) production/transport emissions plus Tank-to-Wake (TtW) combustion emissions, including CO₂, CH₄ (methane slip), and N₂O converted using 100-year GWP.

What is FuelEU Maritime?
FuelEU Maritime (Regulation (EU) 2023/1805) is an EU regulation, in force from 1 January 2025, that mandates progressive reductions in the well-to-wake greenhouse-gas (GHG) intensity of energy used on board commercial ships of 5,000 GT and above calling at EU/EEA ports. It works alongside the EU ETS to incentivize renewable and low-carbon fuels.
How is the FuelEU GHG intensity calculated?
GHG intensity is the energy-weighted ratio of total well-to-wake emissions (grams CO₂e) to total energy used on board (MJ):
GHG = SUM(mass × LCV × GHG factor) / SUM(mass × LCV)
where LCV is the Lower Calorific Value (MJ/kg) and GHG factor is in gCO₂e/MJ.
How much is the FuelEU compliance penalty?
The baseline penalty is EUR 2,400 per tonne of VLSFO-equivalent non-compliant energy:
Penalty = |Deficit (t CO₂e)| / (Actual GHG × 0.041) × €2,400
Under Article 23(2), if a vessel incurs penalties in consecutive reporting periods, the penalty is multiplied by:
Multiplier = 1 + (n - 1) / 10
where n is the consecutive non-compliant year count.
Is LNG compliant with FuelEU Maritime?
In its standard fossil form, no. Because FuelEU uses well-to-wake lifecycle accounting and factors in methane slip (CH₄), the Annex II default intensity for LNG in Otto-cycle medium-speed engines is 92.13 gCO₂e/MJ, which exceeds the 2025 limit of 89.34 gCO₂e/MJ. To achieve compliance, LNG vessels must blend with biomethane (bio-LNG) or synthetic e-methane.
What are banking, borrowing and pooling under Articles 20 & 21?
Banking (Art. 20): Vessels with surplus compliance balance (+CB) can bank surplus indefinitely for subsequent years.
Borrowing (Art. 20): Vessels in deficit can borrow an advance compliance balance from the following year, capped at 2% of target × energy, repaid with a 10% penalty surcharge (not allowed in consecutive years).
Pooling (Art. 21): Two or more vessels can combine their compliance balances into a common pool, allowing over-compliant ships to offset deficit ships, provided the net pool total is non-negative.
